What Can I Claim?

When making a claim for Personal Injury there are two heads of damages, General Damages and Special Damages.

General Damages

General Damages are damages that are assessed to compensate you for the pain suffering and loss of amenity following the accident that you have had. In a nutshell the worse that you have suffered the more compensation you are entitled to.

Once ADF Law has accepted your claim, and at the optimum time during your claim, we shall instruct an independent medical expert to assess the seriousness of your injuries. From this medical examination and subsequent report we will be in a position to advise you on the likely level of damages or, if further treatment is required, instruct private medical treatment on your behalf.

You will note have to pay for any private medical treatment upfront as we will recover the cost of this treatment from the paying insurance company.

Special Damages

When making a claim for Personal Injury you are entitled to claim for any out of pocket expenses that you have incurred as a result of the accident, these are known as Special Damages. Examples of Special Damages may be:

  • Loss of Earnings.
  • Cost of Private Medical Care.
  • Care – We will be able to claim for the time that family members and friends spend assisting in your recovery.
  • Medication/Prescription Charges.
  • Travel Expenses to medical examinations or for treatment.
  • Damaged Items of Clothing or any other items that have been damaged as a result of the accident.
  • Vehicle Damage.
  • Repair and/or Hire Charges.
